RETAIL - TERMS & CONDITIONS

This page (together with our privacy policy) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.dunvegancastle.com/shop to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

YOUR STATUS

By placing an order through our site, you warrant that:

  • you are legally capable of entering into binding contracts
  • you are purchasing the products outside the course of your normal business or trade and not for resale

THE CONTRACT BETWEEN US

After placing an order, you will receive an Email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been processed and despatched (Despatch Confirmation). The contract between us (Contract) will only be formed when we send you the Despatch Confirmation.

The Contract will relate only to those Products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the despatch of such Products has been confirmed in a separate Despatch Confirmation.

STOCK AVAILABILITY

We do try to ensure that we have good stock availability of all our products. However, some goods may sell faster than we predict. If the item you have ordered is not in stock, we will do our best to get it for you as quickly as possible. If we cannot secure the item, we will cancel your order immediately and let you know by email. If we can secure the item but cannot deliver it to you within our delivery policy, we will email you with the option to cancel your order.

PRICE & PAYMENT

The price of the Products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error. 2

If you are ordering from the UK or the European Union, all prices are shown in sterling and include 20% VAT with certain product lines zero-rated. If you are ordering from outside the UK and European Union or from the Channel Islands, all prices are shown in sterling and exclude VAT. Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Despatch Confirmation.

If you are ordering from outside the UK or European Union, your order will be supplied VAT free and a copy of your ex VAT receipt will be despatched with your goods if requested. As all orders are shipped directly from the UK, you may have to pay customs fees when your parcel reaches the country you live in. You are responsible for any import duties, customs and local sales taxes, and you’ll need to pay these fees to release your order from customs. We don’t have any control over customs and import tax and we can’t tell you exactly how much you will be charged, as this varies widely depending on the country you live in (for example, the threshold for goods imported to United State of America is $800, and Canada is $20CAD). Any orders with a value above the threshold amount will be charged import fees, so we recommend contacting your local customs office for more information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. All prices include VAT or GST where applicable.

TO PAY FOR YOUR ORDER

Payment for all Products must be by credit or debit card or by PayPal. We accept payment with Visa, MasterCard and American Express credit cards, as well as Maestro, Visa Electron and Visa Debit cards.

We do not accept payment by cheque.

Our Retail staff are available between 9am and 5.30pm (GMT) Monday to Friday except for the festive holidays over the Christmas and New Year period. Alternatively email [email protected] and we will get back to you as soon as possible.

To protect credit and debit cardholders, all payments are screened using 3D Secure (MasterCard SecureCode and Verified by Visa) and by an independent fraud prevention service. We may contact you for additional security purposes should we deem this necessary.

REFUNDS & RETURNS

By law, you have 14 days beginning the day after receipt, in which you can return the goods in their original unused or unworn condition to us for a full refund. you are only liable for the return shipping charges. If there is a fault with the goods received, you will not be liable for postage costs and we will reimburse your postage costs up to the value of Royal Mail second class postage or its equivalent for international orders. If you wish to use an alternative service, the additional costs must be borne by yourself. Please ensure that you mark all items clearly on the outside of the package as RETURNED GOODS.
